1 Judicial Control of Administrative Action in India and Writs One of the important field of the study of the administrative law is the „? Judicial Control of Administrative Action in India. Today the power of the administrative authorities become very strong and thus it resulted different complications and repercussions in the socio-economic field in India. Therefore, considering the day to day increasing power of the administrative bodies judicial control is become an important area of the administrative law as because the judicial department i. . Courts have proved to be the more effective and beneficiary branch than any other Parliamentary or Legislative or Administrative action for the purpose of the controlling the administrative action in India. In this regard Prof. Jain & Jain rightly quoted that, â€Å"the real kernel of democracy lies in the courts enjoying the ultimate authority to restrain all exercise of absolute and arbitrary power.Without some kind of judicial p ower to control the administrative authorities, there is a danger that they may commit excess and degenerate into arbitrary authorities, and such a development would be inimical to a democratic Constitution and the concept of rule of law† . Administrative law also provides for control over administrative action by an outside agency strong enough to prevent injustice to the individual while leaving the administrative agencies adequate freedom to enable them to carry on effective administration. Administrative Action† is a very comprehensive term in which all the actions of administration are included. Administration is the meeting point of three types of government functions. The executive performs the residue of all these functions which are not vested in the two other branches of government i. e. the legislature and the judiciary. 1 Administration exercises a variety of powers. Administrative action may therefore, be legislative or judicial or neither, i. e. it could be discretionary non-judicial order or merely a ministerial act.All these functions are exercised by the administration. Administrative process in this way cuts across the traditional classification of governmental powers and combines into one, all the powers which were traditionally exercised by three different organs of state i. e. the legislature, the judiciary and the Executive. Power of Judicial control of the Administrative action may be divided under two heads in India :- (I) Judicial Control of Administrative actions by Writs: Administrative actions may be controlled by the Courts by issuing different writs under different circumstances in India.Courts through issuing different writs playing a vital role in the judicial control of administrative actions in India. Article 32(2) provides that the Supreme Court shall have power to issue directions or orders or including writs in the nature of habeas corpus, mandamus, prohibition, quo warranto and certiorari, whichever may be appr opriate for the enforcement of any of the fundamental rights 2 and for the control of the administrative action in India. This right is available only against State as defined under Article 12 of the Constitution of India.This Article provide only Original jurisdiction to the Supreme Court not the Appellate jurisdiction. Thus a person can go straight to the Supreme Court for the protection of his Fundamental rights; this jurisdiction of Supreme Court under Article 32 of the Constitution is considered as a part of the basic structure of the Constitution. Article 226 empowers the High Court to issue writs for the enforcement of the Fundamental Rights as well as for any other oppose. Article 226 provides that notwithstanding 1. C. 803. 2 anything in Article 32, every High Court shall have power throughout the territories in relation to which it exercises jurisdict ion, to issue to any person or authority including in appropriate cases any Government within those territories, directions, orders or which including writs in the nature of habeas corpus, mandamus, prohibition, quo warranto and certiorari, or any of them for the endorsement of any of the Fundamental Rights guaranteed by part III of the Constitution and for any other purpose.Both Article 32 and Article 226 provide five kinds of writs through which administrative action may be judicially controlled along with other actions. Article 226 under clause (4) made it quite clear that though both the Articles provides right of writs under the same heads, i. e. habeas corpus, mandamus, prohibition, quo warranto and certiorari, but the power conferred on a High Court by Article 226 shall not be in derogation of the power conferred on the Supreme Court by Clause (2) of Article 32.Judicial Control over administrative action is exercised through the Constitutional extraordinary remedies and statu tory ordinary remedies as well. Provisions for extraordinary remedies have been made under Article 32 and 226 of the Constitution. For controlling administrative action Supreme Court and High Court can issue the writs of habeas corpus, mandamus, prohibition, quo warranto and certiorari. A short discussion is given hereunder:Habeas Corpus: Habeas Corpus means bring the body.The writ of habeas Corpus is issued as an order calling upon the person who has detain another person to produce the detune before the Court to examine the legality of his detention. If the detune is produced before the Court and the Court finds the detention is illegal then it will order for the immediate release of the person detained illegally. The main objective of this writ is not to punish the person who has detained another person illegally but to secure immediate release of the person detained illegally whether in prison or private custody.Mandamus: The writ of mandamus is, in form, a control or command is sued by the Superior Court (the Supreme Court and High Court) to the Government, inferior court, tribunal, corporation, authority or any other person having public duty to perform asking such the Government, inferior court, tribunal, corporation, authority or any other person to perform the public duty or to refrain from doing illegal act.Thus mandamus is defined as a command issued to direct any person, corporation, inferior court or government requiring them or him to do any particular thing which he or they should do as a duty of his or their office and is in the nature of public duty or to prevent them from doing any illegal act. The purpose of this writ is to compel the performance of public duties prescribed by the statute and to keep a control over the subordinate court, Tribunal, corporation and other officers or administration exercising public duty.Certiorari: The writ of certiorari is the writ, which is issued by the Superior Court (i. e. Supreme Court or the High Court) to the inferior court or Tribunal or body exercising judicial or quasijudicial functions to remove the proceedings from such Court, Tribunal or body for examining the legality of the proceedings. If any order passed by the lower court or Tribunal or body exercising judicial or quasi-judicial functions is found to be illegal by the Superior court then the Superior court may quash or demolish it.It also controls the judicial or quasi-judicial functions of the inferior court or Tribunal or body exercising judicial or quasi-judicial functions exceeding it jurisdiction. 3 The prime aim of the writ of certiorari is to keep judicial control over the inferior courts or Tribunal or bodies functioning judicially or quasi-judicially within the limit of the jurisdiction allocated to them by the law and to prevent them from acting in excess of their jurisdiction.Prohibition : The writ of Prohibition is issued by a superior court to an inferior court or tribunal or body exercising judicial or qua si-judicial functions for preventing such inferior court or tribunal or body exercising judicial or quasi-judicial functions from uprising jurisdiction which is legally not vested to them or from acting in violation of the principles of natural justice or from acting under the unconstitutional law.The object of the prohibition is to restrain the inferior courts or tribunals or bodies exercising judicial or quasi-judicial functions from exceeding their jurisdiction. To control and keep them under the limit of their jurisdiction. Prohibition is an order of Superior courts directed to an inferior courts which forbids the court to continue proceedings in excess of its jurisdiction or in contravention of the law of the land.Quo Warranto: The word ‘Quo Warranto’ means „By what authority?. The writ of Quo Warranto is issued against a person who occupies or holds or usurps an independent sustentative office and asked him to show by what authority he claims it. The procedu re of this writ confers jurisdiction on the court to call upon the person holding an independent substantive public office or franchise or liberty to show by what right or authority he holds the said office or franchise or liberty.The unauthorized or illegal occupant of such office may be ousted by the judicial order and the person entitled to the office may be allowed to hold or occupy it. The object of this writ is to protect or control the right of the citizen through Courts from being deprived of public office to which he may have a right. By this writ the court protects the public from usurpers of the public office and control the administrative action in making appointment of the public office.Through this writ the court protects a citizen from being deprived of a public office to which he is legally entitled to hold. (II) Judicial Control of Administrative action by other than Writs: Some important aspects other than Writs also provided to the Constitution of India for the ju dicial control the administrative action in India. (i) Special Leave to appeal: The power of judicial review conferred on the Supreme Court under Article 136 is special or extraordinary in nature. This power is in the nature of a residuary reserve power of judicial review.Article 136 lays down that the Supreme Court may, in its discretion, grant special leave to appeal from any judgment, decree, determination, sentence or order in any cause or matter passed or made by any Court or Tribunal, except any Court or Tribunal constituted by or under any law relating to the Armed Forces. Since the Supreme Court has been invested with a plenary jurisdiction to hear appeals against the decisions of Administrative Tribunals and other adjudicating agencies, it is now regarded as an important mode of judicial review of administrative adjudications.But this jurisdiction is special and exercisable outside the purview of ordinary law. The Court entertains special leave only where the needs of justi ce demand its interference. 3 (ii) Supervisory Jurisdiction: The power of judicial review which has been conferred on all the High Courts under Article 227 is supervisory in nature. Article 227 provides that ever High Court shall have superintendence over all Courts and tribunals throughout the territories in relation to which it 3. Durga Shanker Mehta v. Raghuraj Singh, A. I. This supervisory power is both judicial and administrative in nature. 4 The supervisory jurisdiction conferred on the High Courts under Article 227 is in addition to the power given under Article 226 to control inferior Courts or tribunals. The supervisory jurisdiction extends to keeping the subordinate tribunals within limits of that authority and ensuring that they obey the law. The power under the article can be exercised even in those cases in which no appeal or revision lie to the High Court5.Though all the above mentioned writs and non-writs power are imp ortant weapons against state (Article 32) as well as against any detune, whether a private person or State (Article 226) for the judicial control of the administrative action in India but the main instinct for the judicial control of the administrative action by writs is the writ of ‘MANDAMUS’ and ‘QUOWARRANTO’ which are equally protective against the violation of judicial as well as administrative action, and among the other than writs power is the ‘SPECIAL LEAVE TO APPEAL’ which empowers to appeal from any judicial and administrative judgment in India. ***** Department of Law, B. Jeremy’s First Day Essay

Jeremy was very excited.   His eyes popped open even before his alarm clock rang. He had been waiting for this day all summer.   It was his first day at his new school.   Jeremy’s mom promised him that this school was going to be even more fun then the one he went to when they lived in his old house before they moved to this town. Jeremy jumped out of bed and quickly got dressed in the outfit had had picked out especially for his first day. He combed his hair and brushed his teeth like his dad told him he should do every morning. Jeremy’s parents were just sitting down to breakfast and were very surprised went he walked into the room. â€Å"My, you sure got ready awfully quickly† said Jeremy’s mother. â€Å"Are you all ready for school?† asked Jeremy’s dad. Then he added, â€Å"Do you think a pancake would help?† Jeremy smiled, â€Å"It sure would!† After they ate Jeremy’s mother looked at her watch and sprung from her chair â€Å"Where did the time go?   We’re going to be late!† They ran to the car and waved good-bye to Jeremy’s dad who reminded him to be good. Jeremy’s mother drove quickly and they got to school just in time.   Jeremy hugged and kissed her good bye and she too reminded him to be good. As he walked into the building, he heard his mom tell him to â€Å"knock their socks off!† Jeremy got to his classroom just as the bell rang and found a seat in the very middle.   All of the other second graders looked at him in wonder.   His dad had told him to expect this.   Jeremy was the new kid.   People would look at him because they didn’t know him and they would be curious about what he was like.   They might want to know about where he was from and what kinds of things he liked to do.   His mom said it might feel funny to be looked at like an animal in a zoo, but that they didn’t mean any harm, and as soon as they were used to him, they would all be friends. The teacher stepped in front of the class and wished them a good morning.   She wrote her name on the board and began to call out the children’s names. â€Å"Anna Abbott?† â€Å"Here† â€Å"Nicholas Baca?† â€Å"Here.† â€Å"Jeremy Dennis?† â€Å"Here.† Everyone got quiet and looked at Jeremy very hard.   Then suddenly a girl in the front row said, â€Å"You’re not a boy!† â€Å"How come he’s wearing a dress?† asked the boy sitting next to Jeremy.   Then everyone began to talk excitedly.   They all wanted to know if Jeremy was a boy then why he was wearing a dress. Jeremy was confused.   No one had ever asked him about his clothes before.   Other students in the class were wearing dresses and no one seemed to notice. The teacher quieted the class and turned to Jeremy. â€Å"Are you Jeremy Dennis?† â€Å"Yes, I am† said Jeremy. â€Å"Welcome to class Jeremy.†Ã‚   She then went back to calling the role. The first day was a very long one.   At recess, everyone wanted to know about Jeremy’s old town and school, but mostly they wanted to know why he was wearing a dress.   Some of the students were very nice and some were not.   Some of them asked questions about what kinds of games Jeremy liked to play and were excited to have him on their soccer team because Jeremy was very good.   Some said mean things to him about his clothes.   Jeremy wondered if their parents had told them to be good this morning too. By the end of the day, Jeremy had learned that even though the school didn’t have any rules about clothes, boys at this school only wore shorts and pants, but girls were allowed to wear anything they wanted.   This seemed unfair to Jeremy. At dinner, he explained to his parents the funny rules the children at this school followed.   Jeremy’s mother sighed and told him that everyone one and everywhere is different and he just had to decide which rules he wanted to follow. That night, as he went to sleep, Jeremy knew exactly what he was going to wear the next day. Discussion Plan This story addresses gender issues are well as the role of authority and rule making and breaking.   Some questions that approach these issues could include: Why did the child say Jeremy was not a boy? What is the difference between a boy a girl? Why do the boys not wear dresses? Are their rules that you follow that are not written down? How do you learn about these rules. Who decides these rules? How do you know if these rules are fair? Other topics to address would be sayings like â€Å"where did the time go?† and what it means to â€Å"be good.†

Nickel and Dimed Essay In the book â€Å"Nickel and Dimed: On (Not) Getting by in America† Barbara Ehrenreich writes of her experiences working and living in what is considered mainstream America. In the sociological perspective the method of research Ehrenreich used was that of participant observation in which the researcher participates in the research setting while observing what is happening in that setting. The type of people studied were the lower middle class, the working class and the working poor. Lower middle class is about 30 percent of the population and members of this class have jobs that call for them to follow orders given by those who have upper middle class credentials. Their technical and lower level management positions bring them a good living, but is usually constantly threatened by taxes and inflation. In Ehrenreich’s book she discusses how these groups of individuals will feel secure in their positions and anticipate being able to move up the social class ladder. The distinction between the lower middle class and the working class on the next lower rung are more blurred than those between other classes, but members of the lower middle class work at jobs that have slightly more prestige and their incomes are generally higher. The focus on the book was more on the working class and the working poor. Another 30 percent of the U. S. Population belongs to this class of relatively unskilled blue collar and white collar workers. Compared with the lower middle class, they have less education and lower incomes. Their jobs are also less secure, more routine, and more closely supervised. One of their greatest fears is being laid off during a recession. With only a high school diploma, the average member of the working class has little hope of climbing up the class ladder. Job changes usually bring more of the same, so most concentrate on getting ahead by achieving seniority on the job rather than by changing their type of work. Ehrenreich worked mainly in this class but in order to make ends meet, she also took a job, cleaning houses that the working poor would normally be employed at. The working poor make up about 22 percent of the population and work at unskilled, lower paying, temporary and seasonal jobs, such as sharecropping, migrant farm work, house cleaning and day labor. Most are high school dropouts. Many are functionally illiterate, finding it difficult to read even the want ads. They are less likely to vote because they feel that no matter what party is elected to office their situation won’t change. Many of these individuals work full time but still have to depend on help such as food stamps to supplement their meager incomes. But with the push to end social institutions in America the problem will only become huge. Ehrenreich’s book shows how easy to see how one can work full time and still are poor. This book shows clearly the workings of the capitalist society we live in. How most live day to day and if they are getting by don’t mind. The working poor are the one’s that will be affected the most by welfare reform and in my opinion no one is really paying attention. The only attention is the bottom dollar; the only thing that is looked at is how much this will increase money for the upper classes. It really wasn’t very shocking to me what was going on when you live and have lived within these social classes. Curious mind, has a zeal to understand what is going on in the surrounding , let it be a natural event or phenomenon or people around, this understanding developed is what I assume frames the basis of knowledge. To quench this thirst provides the necessary fuel required to move on in personal lives. Knowledge provides the purpose and meaning to lead ones personnel life , while saying personal life I mean, the life of a person as guided by him or herself under his or her own instinct, in very own way-not forcefully guided by others rather willfully adopted to lead the personnel life. The question is how a person will drive his life in a specific way? One of the obvious answers could be by having knowledge of what is best for him. This leads to discuss the reason and emotion as the two Ways of Knowing, supported by the Areas of knowledge fueled by ethics and Natural sciences. The essay will try to understand how the reasoning charges the emotion to lead life in a particular way under t he umbrella of Natural sciences in an ethical way, by considering the logical arguments related to it with the help of examples as far as possible. While emotion is a natural instinctive state of mind deriving from ones circumstances, moods or relationship with others, Reason is the cause, explanation or justification for an action or event, reasoning and emotions are closely connected, the decision making relies on emotions, this implies that life is guided by reasoning and emotions, reasoning helps us to foresee the consequences and to judge if the action makes sense, yet what ‘makes sense’ depends upon the emotion. People do not practice any activity without active or passive purpose. They don’t waste time and energy purposelessly specially, a regular exercise of getting knowledge for more than a quarter of their life,Struggling in schools and colleges- investing money,time andenergy. There is Reason behind;true,sometimes the knowledge has a direct and well known purpose whereas sometimes the academic knowledge has some passive purpose but all these knowledge are meant to shape the life of the gainer and struggler for knowledge. The quest of finding the fact about malaria, a deadly disease was, to understand the reason the cause, and its cure, it took long time before the facts got established and a possible treatment was discovered leading to the invention of the medicine.Was this without a purpose? Was there an emotion attached behind, to save the whole human kind? I opine, the pain and sufferings of the patients may have fuelled the research to some extent as well. The natural science and its knowledge are all full with reason and purpose behind all scientific discoveries and inventions and endeavor. True, while trying to find out something purposefully people get extra, even un-associated knowledge of some other type or class which may or may not have an immediate use and purpose in their eyes, for the time being.But the graphic detail of it, remains saved in their mind and is utilized somewhere else in due course of time. or even if unutilized the knower is well aware of the latent information, to keep this piece of work in his brain, so as to utilize it some other time thus, knowledge has two forms namely an active and passive knowledge. It may also be noted that sometimes reason gets defeated by emotions attached to the purpose, a child’s repeated demand of cold drinks while suffering with cold and flu is accepted by father, at this point the knowledge question is, why this acceptance? Possibly, not because of reason but emotion! Talking about the natural science, why do scientists invest their time and brain in new research? Without, any point in their brain? Then what do they do sitting and observing? Till when and why, answering these questions frames the overall purpose of them being there. And these are the knowledge question as well, any new research cannot be carried out in physics or chemistry or biology unless there is a reason behind it, the people from management studies and sciences know it much better, when they say that the most important work for a successful activity is: setting the Goal breaking it into small achievable targets, and then working for the sake of those targets.One by one, to finally achieve the goal, and thus sort out the overall purpose. Scientific research are also done in the same fashion, by setting up goals breaking it into pieces and sequential steps, all forming important steps to reach a solution of the problem, a big tunnel cannot be made or a big mountain cannot be br oken or brought to ground without any purpose. Knowledge establishes facts and information are devised from this fact to help understand life and surroundings in a more refined way which thus provides a better living environment. Now the question is what if there is no purpose behind any peace of quest and there is no curious mind working behind a given idea or set of ideas, will the brain still be working will their still be an idea or creativity from nowhere? Where to start for what when how and many more questions will stand still without any straight or creative answer. So how the quest will take form and why?Another important point worth mentioning out here is the famous instant from Sir Isaac Newton’s life when he wandered as why the apple is falling down on the ground and not going up once it is broken from its branch, which leads to the famous and useful theory of gravitation. This incidence was not only once occurring rather a routine natural process that no one actu ally cared so no purpose and meaning for the people from normal walk of life, so a wandering but purposeful wanderer is needed to really bring meaning and purpose, to shape up knowledge. Or is there any counter claim? Supposing that Mr. Newton was sitting and thinking or dreaming something else at the time of this falling apple, paying no attention to this phenomenon of nature, then what would have happened? The answer is, whatever but not the theory. Ethics is another important area of knowledge which needs to ponder under this debate of knowledge meaning and purpose. Human coordination towards other humans and towards the nature is another philosophical area, which never works without any relationship between purpose, meaning and knowledge. How an ethical rule is defined and or established unless the raw material, a piece of past experience or a smallest of fact is available to the genuine thinkers in this field?Human mind starts working in an active way only with an input of purpose so in here if the main purpose and the meaning are missing from the whole fury of knowledge then nothing as knowledge takes shape. While wandering through wild purposelessly people get involved in watching the plants and trees with highest degree of curiosity only if they have interest in watching and gaining some active or passive purpose behind it others may find interest in watching animals or birds out there. Now if their interest is towards human and ethics the perspective will be different then someone interested in animals and animal protection as compared to someone else who is interested in the delicate balance between all these factors and the new ethical theory or principle formulated will be different from all these theorist and philosophers of ethics. Having said this, we may discuss the academic knowledge as acquired by the scholars at school and colleges, they will have better approach towards their studies, if they have the knowledge and understanding behind their subject of endeavor, if they know the real reason behind the struggle in studies, they will excel in their field as compared to those who are trying to study just for the sake of studying. This is the reason why preface and introduction to the book is written, and written to be placed on the front page. Students undertaking professional qualification always record high percentage of passing out as compared to those who are pursuing a general academic course where the pass percent is comparatively low. Charles Dickens’s voice varies from being sympathetic with the revolutionaries, to a feeling of discord with their method of revolting. A Tale of Two Cities revolves around the French revolution and the tension in England. Dickens gives the tale of a family caught in the conflict between the French aristocracy and radicals. In the course of the book, the family handles extreme difficulty and obscurity. Dickens’s neutrality, though sometimes wavering from side to side, is apparent throughout each book in the novel.   Ã‚  Ã‚  Ã‚  Ã‚     Ã‚  Ã‚  Ã‚  Ã‚  Throughout the book, Dickens portrays his objectivity between the classes through a series of graphic descriptions. For example, the horrid events that occur when the Marquis murders the child is a time when Dickens most definitely favors the rebels. Dickens’s attitude when Jacques kills the Marquis is that justice has been supplied. There is a definite tone of approval in his voice after these actions. On the other hand, Dickens’s attitude towards the mutineers is not always one of endorsement. When the activists nearly kill Gabelle and burn the Chateau, Dickens’s attitude changes from one of approval to one of disbelief. His disposition is almost one of sorrow for all the beauty being carelessly destroyed. As the reader can see, Dickens’s opinion varies greatly in accordance to the portion of the story the person is reading.   Ã‚  Ã‚  Ã‚  Ã‚  Possibly, to find the clearest image of Dickens’s neutrality, the reader needs to gain a larger view of the tale.  Ã‚  Ã‚  Ã‚  Ã‚  As the reader sees a broader picture, a pattern emerges. Dickens, in each book, gives the tale in favor of the different parties, showing his indifference to the outcome of each party. Thus while the reader may form feelings towards the revolutionaries, Dickens stays unmoved by both causes and relates the story accordingly. This way of showing Dickens’s apathy once again proves that Dickens is only partial to either side in certain portions of the book.   Ã‚  Ã‚  Ã‚  Ã‚  Perhaps the clearest illustration of Dickens’s neutrality is located in the very first sentence of the novel. He shows his neutrality through the description â€Å"It was the best of times, it was the worst of times . . .(7).† This unusually comparative sentence single-handedly starts the book with a feeling of un-bias. In the final chapter of the book, six carriages carry â€Å"the days wine† (people) to La Guillotine to be be-headed (374). In this passage, Dickens shows his remorse for what is done. He gives hint that the common-folk were once a good people who are perverted by the aristocracy, and given the same conditions will be perverted again.

The Invasion of Panama The U.S. invasion of Panama on December 20, 1989 was a mark of excellence on the behalf of the U.S. armed forces ability to effectively use the principles of war. This meant they wanted to protect the lives of the 35,000 U.S. citizens in Panama from attacks by Noriega's Panama Defense Force or PDF; they also wanted to protect the lives of Americans at home by attempting to eliminate drug trafficking. Second, they wanted to "protect American interests and rights under the Panama Canal Treaty" (Watson 69). This could be done by abolishing Noriega's control of the workers who operate the canal, and his control of the canal itself. Third, they wanted to "restore a democratic and freely elected government to Panama" (Watson 107). Here, the U.S. would gain control over the country and ensure a fair election. And, finally, they wanted to "apprehend Noriega" (Watson 69) for prosecution in the U.S.. This would ease the difficulty of restoring democracy and eliminating drug trafficking, as well as giving Americans a feeling that justice was being served. These objectives gave the mission clear goals to achieve, allowing for the planing of each task that needed to be completed in order to accomplish the mission. Once objective has been established, the next step was to derive a simple plan, following the principle of simplicity, which is the formation of "Direct, simple plans and clear, concise orders to minimize misunderstanding and confusion" (Stofft 7). When the people began to migrate into eastern Kenya, the Koomenjave or Spiritual Leader divided the Ameru into three groups. The Koomenjave was responsible for keeping law and order.
